A few weeks ago, I was working with a co-worker who posts jobs for the company. We got into a discussion about who is liable when a company hires or retains a search/recruitment firm to post their jobs. I was baffled that he had no idea about the compliance involved in this process and that he did not know that for most federal contractors, there are many issues of liability around this very situation.   The obligatory commitment lies with the primary contractor/company.
