Job Description

The Director of Compliance oversees the recertification and leasing staff, providing day-to-day support and resources relating to HUD project based Section 8 and LIHTC compliance, fair housing, regulatory program obligations and other legal matters.

The Director of Compliance acts on behalf of the Ownership to execute annual administrative operations, to ensure all regulatory requirements are completed successfully and liaises with the various government agencies (HUD, HPD, HCR) to minimize operational risks. Works directly with the Property Manager and Occupancy Specialists, and reports directly to the Owner.

Oversight of Leasing Compliance is a main function of this position, to ensure files are compliant with applicable affordable housing programs. This includes Move-ins, Initial and Annual Recertifications, Interim Recertifications, Gross Rent and Utility Allowance Changes, Terminations, HUD Sec 8 Waitlist management, Emergency Transfers and appeals.

Candidates must have and maintain current, comprehensive knowledge of all applicable affordable housing compliance programs, which include HUD project-based Section 8, Low Income Housing Tax Credit, NY State Rent Stabilization, to ensure awareness of and procedural guidelines for administering and maintaining compliance with those programs.

The Director ensures staff adheres to all HUD, Fair Housing, ADA, Fair Credit Reporting Act and other laws relating to leasing.

Ensures all tenant files, its records and waiting list are maintained in accordance with governing agency's standards.

Audits Resident Files directly and through a third party consulting firm for continued compliance with LIHTC, HUD Section 8 requirements. Completes the annual LIHTC owner certification package, leads audit preparations and closes out correspondence.

Educates residents as to practices, regulations and compliance structure to ensure continued program compliance and uninterrupted rental assistance.

Regularly reviews certification schedules to ensure all re-certifications are processed at least 60 days prior to the effective date of the certification. Monitors waitlists and EIV Master File for compliance with federal regulations and requirements.

Assigns, schedules and carries out a comprehensive internal audit function with appropriate follow-up to monitor and assure community compliance.

Develops and implements all required documents relating to leasing. Ensures all current documents used by staff are up-to-date and compliant with the governing agency. Prepares, updates and submits HUD and LIHTC documents and policies, Project Owner's Certifications, Tenant Selection Plan, Affirmative Fair Housing Marketing Plan, EIV Policies and Procedures, VAWA Emergency Transfers, Section 504 VCA, House Rules, Lease Packages, etc.

Ensures that renting and advertising practices implement the resident selection procedures outlined to ensure adherence to the site's Affirmative Fair Housing Marketing Plan and Tenant Selection criteria, including all targeted occupancy requirements identified in the governing documents. Updates, maintains and implements the in-house compliance manual per current regulations and statutes.

Updates procedural guidelines for administering and maintaining compliance with all affordable housing programs, including but not limited to management tracking and response procedures for MORs, REACs, general agency inquiries and internal audits.

Provides training and guidance on Fair Housing requirements to interpret complex fair housing requests, provide alternative solutions and assures appropriate, timely responses.

Assists with annual OCAF, Utility Analysis, HAP payment discrepancy resolution and repayment agreements.

Trains and evaluates staff performance, following the community's standard operating procedures. Promptly responds to all incoming calls, messages and emails in a professional, respectful manner and performs other duties as assigned.
