About The Department of Financial Institutions:

The Department of Financial Institutions was created by the Indiana Financial Institutions Act of 1933, which commissioned the Department with the responsibility for supervising commercial banks, trust companies, private banks, savings banks, building and loan associations, credit unions, and finance companies incorporated under the laws of the State of Indiana. The Department’s scope of regulatory responsibilities has since been broadened to include supervision of pawnbrokers, licensees under the Uniform Consumer Credit Code, licensees under the Indiana Small Loan Act, industrial loan and investment companies, money transmitters, check cashers, budget service companies, and rental-purchase agreement companies.

About the Job:

As General Counsel, you will serve as one of two General Counsels for the State of Indiana Department of Financial Institutions. As part of the General Counsel DFI Team, you will work collaboratively to provide legal advice, guidance and support to the Director, Deputy Directors, Department Members, and Supervisors relative to legal matters that affect the agency. You work in conjunction with agency management, other state and federal regulators, other state agencies within Indiana, and industry groups in the research, drafting, and promotion of Department related matters and legislative initiatives.

A Day in the Life:

The essential functions of this role are as follows:

  • Works in support of the Director and the Members Board to provide assistance and support for agency initiatives
  • Works with Deputy Directors and staff for both the depository and consumer credit divisions to provide assistance and support in responding to industry proposed activities
  • Provides guidance and administrative interpretations and opinions; evaluates and responds to examination issues including citations and recommendations
  • Establishes strategies and procedures for the liquidation of troubled or failed financial institutions
  • Prepares and prosecutes enforcement actions as permitted by the adjudicatory authority provided to the Department under the relevant statutes administered by the Department as well as the Indiana Administrative Orders and Procedures Act
  • Works with the Director and the Deputy Directors on the agency’s legislation efforts Includes drafting and reviewing legislation and working with industry professionals, regulatory peers, and legislators to determine needs for new legislative initiatives
  • Works with the Director and Deputy Directors to provide testimony on behalf of the Department before assigned committees
  • Assists the Deputy Director of Administration in review of policies and procedures, contracts, personnel matters, public record requests, ethics determinations, and other matters as they arise
  • Provides assistance and support to the depository analyst in reviews of applications for structural changes (mergers, acquisitions, conversions) received from regulated institutions to ensure compliance with appropriate state and federal statutes
  • Provides assistance and support to the consumer credit licensing, registration and complaints staff regarding the applications and/or licensing of entities, complaints against licensed entities, and/or issues regarding unlicensed/unregistered activities
  • Administers and oversees the prosecution of claims, institution of cease and desist orders, revocations of licenses, imposition of fines, and/or the removal of officers and/or directors from entities over which the Department has regulatory enforcement, administration, and oversight 
  • Works with the Indiana Attorney General and other law enforcement or regulatory officials as necessary
  • Researches, drafts, circulates, and discusses legal interpretations of state and federal statutes as well as policies of state and federal regulatory agencies 
  • Drafts and provides agency administrative opinions and interpretations concerning certain business practices of regulated industries for publication and distribution
  • Provides guidance and resources to financial institution professionals, consumer financing industry professionals, attorneys, and Indiana citizens relative to matters that fall within the purview of Department responsibilities and regulatory administration

What We’re Looking For:

The ideal candidate in this role must have a Doctor of Jurisprudence degree and be admitted to practice law in the State of Indiana and have at least seven (7) years of previous professional experience with at least five (5) of those years preferably working in- house with a regulatory agency, financial institution, or consumer financial services industry, or in private practice having represented similarly situated clients.

  • Must possess a high degree of professionalism and have excellent written and verbal communication skills 
  • Must be able to clearly and effectively present information to audiences consisting of industry professionals, legislators, attorneys, accountants, the Department’s Members and the agency staff 
  • Must have superior research skills and possess effective organizational skills 
  • Must be capable of working autonomously and highly effective in managing and prioritizing deliverables
  • Must be capable of developing collaborative relationships with individuals from the Department, other state and federal agencies, industry trade associations, and other industry professionals 
  • Must maintain flexibility to adapt to a changing environment and unpredictable work demands 
  • Must be motivated, ambitious, and able to work with minimal supervision
Supervisory Responsibilities/Direct Reports:
This role provides direct supervision for one or more staff members.
